These Sales Terms and Conditions (“Sales Terms”) govern the purchase of products and services by consumers through Oofos.com (“Website”). By placing an order on the Website, you agree to be bound by these Sales Terms, which supplement and are incorporated by reference into the Website Terms of Use. Please review these Sales Terms carefully before making any purchase, as well as our Privacy Policy, which describes how we collect, use, and share information in connection with your purchase and use of the Website. If you do not agree, you may not place an order through the Website. 

1. Warranty and Return Policies 

Every pair of OOFOS purchased from OOFOS.com or an authorized OOFOS dealer is warranted to be free of defects in material and workmanship for six months from the date of purchase. If, upon inspection, we determine there is a defect in your OOFOS, we will replace them with a new pair of the same style, color and size. If unavailable, a pair of the same price will be substituted as determined by our team or you may request a different replacement item currently in stock on OOFOS.com. We are unable to refund the difference in price if a replacement pair of lesser value is requested. Please confirm the size and style requested for your replacement, as we are unable to offer returns or exchanges on any warranty replacement.

To submit a warranty claim on a product purchased from an OOFOS-authorized seller, please file your warranty claim directly with that authorized seller.   

Limitations on Warranty. OOFOS’s liability for any defect in a product, whether based on contract, tort, warranty, strict liability, or any other theory, shall not exceed the purchase price of the defective product. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER ORAL, WRITTEN, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. IN PARTICULAR, THERE IS NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE REMEDY OF REPAIR OR REPLACEMENT PROVIDED UNDER THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER REMEDIES. OOFOS SHALL HAVE NO LIABILITY TO THE CUSTOMER FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY NOT CAUSED BY NEGLIGENCE OF OOFOS, PROPERTY DAMAGE, LOST PROFITS OR OTHER ECONOMIC INJURY DUE TO ANY DEFECT IN THE GOODS OR ANY BREACH OF THIS AGREEMENT BY OOFOS. OOFOS SHALL NOT BE LIABLE TO THE CUSTOMER IN TORT FOR ANY DEFECT IN THE DESIGN OR MANUFACTURE OF THE GOODS. No representative, agent or dealer of OOFOS has authority to modify, expand, or extend this Warranty, to waive any of the limitations or exclusions of this Warranty, or to make any different or additional warranties with respect to any Goods or services furnished by OOFOS. This Warranty is non-transferrable. 
 

2. Authorized Retailer Terms 

Only entities expressly approved by OOFOS in writing may purchase products for resale. Authorized resellers must comply with the OOFOS Authorized Retailer Standard Terms and Conditions of Sale, including restrictions on pricing, advertising, and sales channels. Unauthorized resale or distribution is strictly prohibited, and OOFOS reserves the right to revoke reseller status or cancel orders placed for resale without notice.  Purchases made on Oofos.com are for personal use only and may not be resold, unless you are an Authorized Retailer. Unauthorized resale, diversion, or distribution of OOFOS products violates these Sales Terms and may result in cancellation of orders and termination of access to the Website. 

3. Gift Card Terms and Conditions 

OOFOS gift cards may be redeemed exclusively on Oofos.com and are not refundable, redeemable for cash, or transferable. Gift cards do not expire and are not subject to service fees. Lost or stolen gift cards will not be replaced. The purchase and use of gift cards is subject to these Sales Terms, the Gift Card Terms and Conditions and the Website Terms of Use. Gift cards may not be used to purchase other gift cards or for unauthorized resale. 

4. Transfer of Title and Risk of Loss 

Title to products and risk of loss pass to the purchaser upon OOFOS’s delivery to the carrier for shipment. OOFOS is not responsible for loss or damage after shipment. Please inspect your order upon delivery and report any issues promptly. 

5. Reservation of Right to Reject or Cancel Orders 

OOFOS reserves the right to reject, cancel, or limit any order at its sole discretion, including but not limited to orders suspected of fraud, unauthorized resale, pricing errors, or violation of these Sales Terms. If your order is cancelled after payment, you will be issued a refund to your original payment method.  

6. Order Acceptance 

Your order constitutes an offer to purchase products from OOFOS. After you place an order, we will send you an email confirmation acknowledging receipt of your order; this acknowledgment does not constitute acceptance of your order. OOFOS accepts your order, and a contract of sale is formed, only when we charge your payment method and ship the products (or, for digital items such as gift cards, when we deliver them electronically), unless otherwise stated by us in writing. OOFOS reserves the right to decline, cancel, or limit any order prior to acceptance, including after an order confirmation is sent. 

7. Pricing 

All prices are displayed in U.S. dollars and are exclusive of applicable taxes, shipping fees, and surcharges. Applicable sales tax will be calculated and collected at checkout based on the information you provide and the shipping destination. If you are an exempt purchaser, you must provide any required documentation prior to purchase in accordance with our instructions. If international shipping is offered in the future, you will be responsible for any duties, customs fees, import taxes, brokerage fees, or other charges imposed by the destination country, unless otherwise expressly stated at checkout. OOFOS strives for accuracy in pricing but reserves the right to correct errors and adjust prices as needed. Your order total will reflect any such adjustments prior to payment. Promotional pricing and offers are subject to change without notice. If a product is mistakenly listed at an incorrect price, OOFOS reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. 

8. Payment Methods and Processing 

OOFOS accepts major credit cards, debit cards, PayPal, and other payment methods as indicated at checkout. Payment is processed at the time your order is placed. All transactions are subject to verification and approval. OOFOS does not store full payment information beyond what is necessary for transaction processing. Your payment must be authorized and funds available for your order to be fulfilled. 

9. Preorders and Backorders 

From time to time, certain products may be offered on a preorder basis or may be placed on backorder. Any shipment dates or availability estimates are provided for convenience only and are not guaranteed. We may charge your payment method at the time your order is placed (or at such other time disclosed at checkout). If we are unable to fulfill a preorder or backorder item within a reasonable time, we may cancel the item and issue a refund to your original payment method. You may be able to cancel a preorder or backorder before it ships by contacting customer support; however, cancellation requests are not guaranteed once processing has begun. 

10. Shipping and Delivery Policies 

Shipping options, estimated delivery timelines, and rates are presented at checkout and detailed in our Shipping Policy, available at [URL]. OOFOS is not responsible for delays outside its control, including carrier delays or force majeure. Shipping is available within the United States; international shipping is not currently offered. 

11. Product Availability; Product Descriptions; Color and Display Disclaimer 

All products are subject to availability, and we do not guarantee that any item will be in stock at the time you place an order. We reserve the right to discontinue or modify products, features, specifications, and pricing at any time without notice. We try to display product colors and images as accurately as possible; however, actual colors you see may vary depending on your device, display settings, and lighting conditions. Product descriptions, sizing guidance, imagery, and other content on the Website are provided for convenience and may contain errors or inaccuracies; we do not warrant that such content is complete, current, or error-free. If a product you receive is materially different from the product description, your exclusive remedy is to return it in accordance with our applicable return policy. 

12. Fraud Prevention 

OOFOS may employ fraud prevention measures, including order screening, identity verification, and refusal of suspicious orders. If unauthorized activity is detected, OOFOS reserves the right to cancel orders, restrict account access, and report incidents to appropriate authorities. Consumers are responsible for safeguarding account information and promptly reporting suspected fraud.

By placing an order through Oofos.com, you acknowledge and agree to these Sales Terms and Conditions, as well as the Website Terms of Use and Privacy Policy, which are incorporated by reference.
